RENTAL AGREEMENT & POLICY
This is a rental agreement to book El Mercado Local, located at 413 Main Street, Holyoke, MA 01040. It is a binding agreement between Nueva Esperanza, Inc. ("Licensor") and the individual/renter named below, ("Licensee" or "Renters"), outlining the terms of the limited license to use the premises.
Nueva Esperanza, Inc. (licensor) hereby grants to the individual or entity named below (hereinafter referred to as the "Licensee" or "Renters") a limited license stated in the agreement below to use of the premises located at 413 Main Street, Holyoke, MA 01040. (hereinafter referred to as "El Mercado" or "the premises"), during the date(s) and times(s) set forth below.
RENTAL RULES
Hall Access and Event Times
- Renters are permitted to access the hall starting at 9:00 AM on the day of the event.
- All events must end by 12:00 AM.
- AC should not be set below 67 degrees- failure to do so will result in loss of deposit.
- AC and Heat must be turned off at the end of the event- failure to do so will result in loss of deposit.
Prohibited Items and Actions
- No Loitering is allowed in front of El Mercado (413 Main Street, Holyoke, MA).
- Doors must remain closed at all times during the event.
Capacity and Safety Rules
- Maximum occupancy is 100 people.
- Unplugging any equipment, including the security cameras, is strictly prohibited. Tampering with security cameras will result in the forfeiture of the deposit.
Decorating Policies
- No tape, staples, or adhesives may be used on walls, windows, ceilings, or columns.
- No hanging decorations from doors, ceilings, or vertical surfaces.
- No rice, glitter, confetti, candles, or open flames are allowed inside or outside the hall.
Prohibited Equipment and Activities
- Smoking, vaping, hookah, fog machines, and bounce houses are prohibited.
- Violations will result in the loss of the full deposit, and renters will be prohibited from future rentals.
Furniture and Equipment Use
- Tables and chairs provided are limited to current inventory.
- Commercial Fridge available & may be used for refreshments and food storage. All items must be removed, and the refrigerator cleaned after the event.
- Any outside equipment must be approved by Nueva Esperanza, Inc. in advance.
Noise and Music
- Renters are responsible for ensuring that noise levels, including music, remain reasonable to avoid creating a public nuisance.
Post-Event Cleaning
- The hall must be returned to its original condition.
- Decorations, personal items, & equipment must be removed from the premises.
- Food and trash disposed of properly.
- Trash must be taken to the dumpster behind 401 Main Street. Trash left in the hall or other areas will result in forfeit of the deposit.
Deposit and Payment Policies
- A refundable security deposit is required. Violation of any rules will result in the loss of the deposit.
- Full payment is due two weeks before the event. If payment is not received, the agreement may be canceled, and the deposit forfeited.
Cancellations and Rescheduling
- Cancellations will result in forfeiting your deposit.
- Date changes within two weeks of the event will result in forfeiting your deposit.
- Nueva Esperanza, Inc. reserves the right to cancel events with a two-week notice and will issue a full refund.
Damage and Liability
- Renters are responsible for any damage to the premises, equipment, or fixtures beyond normal wear and tear. The cost of repairs may exceed the deposit.
- Nueva Esperanza, Inc. is not liable for personal property damage, loss, or injury unless caused by negligence. All personal property brought onto the premises by the renter, their agents, or guests is at the sole risk of the owner. Nueva Esperanza is not responsible for any loss, theft, or damage to such property, nor for injuries occurring on the premises unless caused by its negligence.
- Renters agree to indemnify and hold Nueva Esperanza, Inc., its agents, and employees harmless from any liability arising from nuisances, negligence, or improper conduct by the renters, their agents, or guests.
During the term of this License Agreement the Licensee may have exclusive use of the facility during the specified time of the License, provided that nothing in this Agreement shall be construed to derogate from the provisions of the foregoing paragraph.
This Agreement is a binding contract between the Licensee and Nueva Esperanza, Inc., and it is governed by the laws of the Commonwealth of Massachusetts.
